The 89 year-old man who Gary Collins crashed into while drunk driving has died.
Warren Gates had been in the hospital since the October accident and died Friday night.
Collins pleaded no contest last Thursday to DUI charges and was sentenced to 96 hours in jail. It is possible that Collins may be hit with additional charges, but it’s not known yet if that will happen.
UPDATE: Prosecution sources tell TMZ Collins will not be prosecuted for manslaughter for two reasons. First, officers say Gates caused the crash by making an illegal left. In order to prosecute for manslaughter, the D.A. must prove that Collins caused the accident. Also, because Collins pleaded no contest to DUI, double jeopardy attaches. So Gary will serve his 96 hours in jail and then its case closed.

Well, having already done almost two years of my life in jail for 8 DUI’s, all I can say is “Gary, get ‘em over with!” They won’t be going away and I don’t think you’ll particularly happy sitting in jail for four days when you’re in your 90’s!!!!!!!!!!!!!
I’m sorry to hear that Gary Collins was involved in a DUI… I’m no fan of drunk drivers, and although the other individual (the late Mr. Gates) caused the accident, this doesn’t release Mr. Collins from civil liabilities involving Mr. Gate’s death…
