Katie Holmes Files For Emergency Custody And Child Support Hearing

It looks like Katie Holmes is a force to be reckoned with. With her and husband Tom Cruise splitting, she’s coming out of the robotic shell she kept herself in during the five and a half years that they were married, and she won’t be messed with in this divorce.

As we told you all a few days ago, Holmes is looking for sole custody of daughter Suri, and even filed divorce papers in NYC, thinking New York courts would be more apt to grant her it than California courts.

It’s possible Holmes got word that Cruise would be filing his own papers in California in hopes to have the divorce proceedings follow through there, because reportedly Holmes’ lawyers have filed for an emergency custody and child support hearing in New York.

According to Radar, the paperwork was filed Tuesday by Allan Mayefsky, one of the actress’s attorneys, and a hearing has been set for July 17 before a New York judge named Matthew Cooper. Both Holmes and Cruise are expected to be there.

Apparently Cruise, who is being represented by Los Angeles lawyer Dennis Wasser, will need to hire a lawyer to represent him in New York, if he hasn’t already.

UPDATE as of 7/5/12: According to People, Katie’s lawyers did NOT file for any such hearing. Says her lawyer, “Other than her action for divorce, the only pending application filed by Ms. Holmes remains her request for an anonymous caption.”
